Pregnancy discrimination
Pregnancy discrimination in the workplace is a form of sex discrimination, and is equally unlawful. Pregnancy discrimination in the workplace is a particularly insidious form of discrimination for a variety of reasons. For instance, the stress and humiliation of being subjected to pregnancy discrimination can have devastating effects on the physical health of a pregnant mother and her unborn child. In addition to health risks, pregnancy discrimination can be economically disastrous, particularly if the discrimination results in the loss of health benefits at a time when such benefits are particularly important.
Pregnancy discrimination can also occur when an employer discriminates against an employee who experiences pregnancy related medical conditions. Such conditions can include undergoing medical treatments such as in vitro fertilization in an attempt to become pregnant, abortions, miscarriages, lactating or breastfeeding, or health conditions or complications related to pregnancy or childbirth.
Pregnancy discrimination can take many forms
Like other types of workplace discrimination, pregnancy discrimination can occur in a number of ways. For instance, an employee may be subjected to harassment, name calling, or other inappropriate behavior because of her pregnancy or pregnancy related medical conditions. Discrimination in the workplace can also occur when an employee or prospective employee, because of her pregnancy or intention to become pregnant, is turned down for employment, unfairly disciplined (including receiving negative performance reviews), passed up for a raise or promotion, terminated or laid off, paid less than other employees, or is subjected to other acts that affect the terms and conditions of his or her employment.
There are also laws in place to provide women with leaves of absences for pregnancy, maternity leave, and pregnancy related medical conditions, including the Family and Medical Leave Act (“FMLA”), the California Family Rights Act (“CFRA”), the Pregnancy Discrimination Act (“PDA”), and the California Pregnancy Disability Leave Law (“PDLL”). Men may also be entitled to certain leave rights associated with a partner/spouse’s pregnancy, pregnancy related medical conditions, and the birth of a child. In addition, employers are generally required to reinstate an employee returning from pregnancy leave to the same position she held before going on leave.
